Purdue University The Use of Technology in Criminal Procedures Essay

Question Description

write 10 pages double spaced (but not more than 11)

NO PLAGIARISM!

The paper is to be at least 10 pages long (excluding the title page, abstract, graphics and the bibliography). Font size is 12 point (Times New Roman or Ariel only), with standard oneinch margins, double spaced. The papers topic must deal with a particular area of criminal procedure, or a right related to criminal procedure. I will allow you to pick your own topic, however it must be approved in advance. Your topic proposal is a onepage summary (using the same font and spacing requirements previously indicated)in which you layout what you intend your paper to entail. The purpose of the proposal is for me to review and approve your topic selection. The paper should adequately represent that you havean understanding of the topic and have given it a thorough analysis. General statements without research to support a position will not be considered favorably. Your work product should show that you did more than write a position paper, but rather show that you researched the topic.I require a minimum of 7 sources but expect many of you may use significantly more. These sources must be from a real book or journal, law reviews. Internet versions of journals and books are fine.

So the instructions are very basic: minimum 10 pages, arial or times new roman 12, format is not requested but i prefer mla or apa, minimum of 7 sources (journals, books, and at least 4 law reviews). I will send you my proposal. Please include that in the essay as much as you can. The topic is Technology in Criminal Procedures. Bring some court case examples where technology was used. Please follow these instructions, and if you read the proposal it says what it all should be about.

Technology in Criminal Procedures

It is not a secret that technology is present in every aspect of our lives, and it has become inseparable part of our lifestyle. It is almost impossible to find a person who does not own a smartphone, a computer or other electronic devices known to make our lives easier. It is hard to find a store or a business facility that doesn’t have security cameras installed all over. However, as technology progresses, it arises a lot of privacy questions and makes you wonder if it is actually beneficial for us or not. What is the role and purpose of technology in our lives? How much information the government can obtain by using it? How does the criminal justice system employ technology to solve crimes? And are there limits of technology use in criminal investigations?

These are the questions I ask myself when I use any smart electronic device. I chose to research about this topic because it particularly interests me, and I think more people should ask themselves that. It is true that an increasing number of cities worldwide are relying on surveillance cameras as a tool for preventing crimes and supporting investigations. More and more people have home cameras that, supposedly, make them feel safer and protected. However, how much is really known about the effect of surveillance cameras on crime, or weather cameras reduce crime or just relocate criminal activity to other areas. My term paper will employ detailed analysis of regulations and laws about using technology to obtain information for solving crimes, and about the legal and illegal aspects of that. I will be focusing on cases when technology helped solving crimes, and on cases when it actually made it more difficult because there are certain boundaries even the police can’t cross. I think this is an interesting topic and I will enjoy doing more research about it.

if you have any questions please let me know. It is a research term paper for criminal procedures class, so it has to be based on real court case examples and life examples where technology intervenes. Advantages and disadvantages of it.

It says minimum of 10 pages. please don’t go over 11 or 12.

United States: The Fourth Amendment adapts to new technology. On December 18, 1967, the Supreme Court ruled in Katz v. United States, expanding the Fourth Amendment protection against “unreasonable searches and seizures” to cover electronic wiretaps.

FORTH AMENDMENT PROTECTS PEOPLE, NOT PLACES

Also talk about the exclusionary rule:

The exclusionary rule prevents the government from using most evidence gathered in violation of the United States Constitution. The decision in Mapp v. Ohio established that the exclusionary rule applies to evidence gained from an unreasonable search or seizure in violation of the Fourth Amendment.

also please discuss about REASONABLE SUSPICION and PROBABLE CAUSE, which are needed for SEARCH AND SEIZURES. And the differences between them.

I know maybe my notes are annoying but I want to make sure you cover the materials we discussed in class.

If it’s possible also write a little about “third party doctrine” – The law allows the government to constitutionally obtain information from third parties without a warrant.
