LE 240 RC The Stopped School Bus Driver Violated Statute 169 09 Subdivision Essay
Question Description
use minnesota law
Read the scenario below and then address the items requested beneath it.
Scenario A school bus was dropping off about five children on a residential street. The children got off the bus and moved in front of the bus as they should. As the bus driver was checking the mirrors for traffic, the children started crossing. Just then a car came racing around the corner blowing past the school bus in the same direction and hitting the first child that was crossing. Even worse, instead of stopping, the car braked hard and then accelerated away from the scene. The bus driver noted that after the vehicle drove off at high speed, it struck a fence while rounding the corner. The bus driver was in shock, though, and wasn’t able to record the license plate. Fortunately, a parking lot security camera was believed to have captured the vehicle traveling away from the scene. The film was sent to the office, and the images were being enhanced to get a lead in the case. As it turned out, the child’s injuries were severe in nature, and the community was severely upset. Naturally, they wanted justice. |
The investigator in the case, who isn’t familiar with school bus law, would like you to compile a list of three (3) primary vehicle related violations that could potentially be charged against the party who drove past the school bus and hit the child.
In a 1-2 page paper, written in APA format using proper spelling/grammar, address the following:
- Using the index from Chapter 169:
- determine one (1) violation from the category “School Bus Safety”
- determine one (1) violation from “Traffic Collisions”
- Determine what one (1) criminal (609) charge would apply.
Be sure to list specific statutory subdivisions for each charge/violation and support each by describing the elements involved
